Manson Project Update: January 28, 2003

1. Information provided by Candec Consultants
On January 21, 2003, B. Moore of Candec Consultants has provided the following information re the City Update of January 17, 2003:

This serves to inform you that no one associated with Yellowmoon Homes, Candec or National Excavating was on site in January 2003 performing any clean up work or picking up any transite.

Tests and on-site visual inspections relating to the confirmation of satisfactory clean up have been performed on a number of occasions since the beginning of December 2002. The most recent being last week.

Regarding the claims that are being made in relation to transite fragments being collected or clean up work being carried out in the past few weeks, you may judge their veracity in the light of the foregoing disclosure.

2. Information provided by the Ministry of Environment (MOE)

In response to requests from the City to clarify the time line of site activities and respond to queries from residents, Allison Lee Lai of the MOE has advised as follows on January 24, 2003:

a. Re: Status of the Manson Project

The management of the site remains with the property owner and those undertaking the work. The audit does not eliminate the need for decision making or the use of professional skills and judgement to ensure that the site is suitable for the intended use.
There was a communication error with regards to when the transite pieces were removed from the site. These pieces of transite resulted from the concrete removal and were disposed of in December 2002. This was the last area which the contractor had worked on to remove the concrete. The Ministry of the Environment was not advised in advance of the removal of the transite pieces from the property and is not required to be on site during that type of work.
Air monitoring and wetting down of the area is not required during the picking up of transite pieces from the site. The pieces of transite were bagged and disposed of at a licenced receiving facility. I must emphasize that the removal of transite pieces from the site does not violate any part of this Ministry's legislation nor the audit process.

The audit allows the Ministry to monitor how the Guideline was used and will be used to determine if the various steps outlined in the Guideline were followed. The audit team will check to see if the following was conducted:
- the supporting information prepared by the consultant is accurate and agrees with the site conditions as stated on the RSC, - the chosen level of restoration is suitable for the intended use of the site and
- the site restoration has been completed such that the site is not likely to cause an adverse effect.

If a site fails the audit, a letter will be sent to the proponent stating the reasons for the failure. The proponent must then repeat the process again and submit a new RSC to show that the site has been remediated to be suitable for the intended land use.

Please be assured that if any part of this Ministry's legislation is contravened the appropriate action will be taken.
At this time, the Toronto District Office does not have a time frame for the completion of the audit of the site.

3. Information provided by the Ministry of Labour (MOL)

In response to a request from the City to clarify the time line of site activities, C. Beatson of the MOL has advised as follows on January 24, 2003:

Due to a miscommunication , there was misunderstanding re the time line for site activities. The transite pieces were removed in mid December 2002, and only on-site testing was done in January 2003.
There is no activity on the site other than noted above. Ministry inspector is continuing to visit the property.

4. The next Update is scheduled for February 7, 2003.

a. Re: Site Activities

On November 15, 2002, a resident contacted me and informed that there was some site activity on the property on November 14, 2002. I contacted National Excavating & Grading Ltd. and Candec Consultants regarding what type of activity occurred on the site on November 14, 2002. I was informed that a worker changed the engine oil from the excavator and some of the material spilled. Candec Consultants noticed that the impacted area was not cleaned up properly and instructed the contractor to clean up the area by removing the soil and disposing of it at a licenced receiving facility. The MOE contacted the Ministry of Labour (MOL) and based on the information from that department, the consultant and the contractor, I am satisfied that the impacted soil was removed from the site and disposed of properly.
